• You are responsible for all activity that occurs under your account, including usage by team members.

3. Payments and Billing

• If you subscribe to a paid plan, you authorize us to charge your payment method immediately and on a recurring basis.

Our Position:

• We do not guarantee the accuracy, completeness, or timeliness of AI-generated predictions or insights. You are solely responsible for verifying and acting upon such data.
• AI models are probabilistic by nature and may produce errors or unexpected results. You should validate outputs before making business decisions.
• We may use aggregated, anonymized data to improve our AI models and Services, but will not share your specific data with third parties except as described in our Privacy Policy.

• Integrations with third-party platforms may be modified, suspended, or discontinued at any time, with or without prior notice

All rights, title, and interest in and to the Services, including all intellectual property rights, are and will remain the exclusive property of Predictent AI Ltd and its licensors.

You retain ownership of any data you provide to the Services. By using our Services, you grant us a limited license to process, analyze, and store your data solely for the purpose of delivering the Services to you.

11. Limitation of Liability

To the maximum extent permitted by law, Predictent AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Business interruption or downtime
• Damages arising from inaccurate predictions, insights, or recommendations generated by our AI

Our total liability to you for any claims arising from or related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

Predictent AI shall not be liable for any adverse action, suspension, or limitation imposed by third-party platforms as a result of your use of our Services.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under English law.

You agree to indemnify and hold harmless Predictent AI Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of a third party
• Your violation of applicable laws or regulations, including data protection laws

13. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

• At the end of the trial period, your access will be suspended unless you subscribe to a paid plan.
• We reserve the right to modify, suspend, or discontinue trial offerings at any time.
• Trial eligibility is limited to one trial per person or organisation. Abuse of trial offers may result in account termination.

16. Right of Withdrawal (EU Consumers)

If you are a consumer located in the European Union, you may have a statutory right to withdraw from a distance contract within 14 days of entering into it, without giving any reason.
